01 — Agreement

Acceptance of these terms

By accessing or using Enjoy the Pain, you agree to these Terms and Conditions and to any policies or disclaimers incorporated into them by reference.

If you do not agree, you should stop using the website. Merely browsing the website does not require you to create an account or purchase anything.

About Enjoy the Pain

Enjoy the Pain is a fitness and performance media website. It may publish articles, interviews, videos, product features, training information, nutrition content, newsletters, advertising and other editorial material.

The website may change over time. Features, categories, content formats and services may be added, modified, suspended or removed.

Unless separate purchase terms are displayed, browsing the website or subscribing to a free newsletter does not create a contract for the supply of paid goods or services.

You may view and temporarily store website material for personal use. You may also share a standard link to a publicly available page.

Third-party trade marks, photographs, videos and other materials remain the property of their respective owners.

You retain ownership of material you submit. By submitting material for consideration, you confirm that:

Submission does not guarantee publication, response, payment or any commercial relationship. We may decline, moderate, edit or remove submitted material where reasonably necessary.

We will not publish or commercially reuse substantial submitted material outside the purpose for which it was provided unless we have permission or another lawful basis to do so.

Fitness, health and nutrition information

Fitness, health, nutrition, recovery and supplement content is general editorial information. It is not personalised medical, physiotherapy, dietetic or exercise advice.

You are responsible for deciding whether an activity, product or recommendation is appropriate for your health, ability, experience and circumstances.

08 — Revenue

Advertising, affiliates and sponsorships

Enjoy the Pain may display advertisements, affiliate links, sponsored content, gifted products and other commercial partnerships.

We may receive a commission or another benefit when you click a link, purchase a product, register for a service or engage with a partner. This will not ordinarily increase the price you pay.

Commercial relationships should be disclosed where relevant. More information is available in our Affiliate Disclosure.

A paid or affiliate relationship does not make Enjoy the Pain the seller, manufacturer or service provider unless expressly stated.

09 — External services

Third-party websites and services

The website may link to retailers, social platforms, software providers, event organisers, coaches, practitioners and other third parties.

Those third parties operate under their own terms, privacy practices, prices and policies. We do not control their websites, transactions, availability, content, security, delivery, returns or customer support.

A link or mention does not automatically mean that we endorse every product, claim, practice or opinion associated with the third party.

10 — Communications

Newsletter and electronic communications

When you subscribe to the Enjoy the Pain newsletter, you consent to receive the types of emails described at the point of subscription.

You may unsubscribe at any time using the unsubscribe link included in marketing emails. Unsubscribing from marketing does not prevent us from sending messages necessary to respond to an enquiry or administer a transaction.

You are responsible for providing an email address you are authorised to use and for keeping your contact information accurate.

Accuracy and website availability

We aim to keep the website useful, accurate and available, but content may contain errors, become outdated or be unavailable from time to time.

Prices, specifications, research, schedules, offers and third-party information may change after publication. You should verify important current information with the original provider before relying on it.

Consumer guarantees and non-excludable rights

If Enjoy the Pain separately supplies paid goods or services, additional purchase terms may apply. Those additional terms will operate alongside, and will not remove, applicable non-excludable consumer rights.

Any limitation or exclusion in these terms applies only to the maximum extent permitted by law.

13 — Responsibility

Liability

To the maximum extent permitted by law, Enjoy the Pain does not guarantee that free editorial content will be error-free, continuously available, secure or suitable for every purpose or individual.

To the maximum extent permitted by law, we are not responsible for loss arising solely from:

  • Your unlawful or prohibited use of the website.
  • Your reliance on general content without considering your individual circumstances or obtaining appropriate advice.
  • The independent acts, omissions, products or services of third parties that we do not control.
  • Events outside our reasonable control, including widespread network, hosting or infrastructure failures.

This section does not apply where liability cannot lawfully be excluded or limited. It also does not exclude liability for fraud, wilful misconduct or any other liability that the law does not permit us to exclude.

Changes, restriction and termination

We may update these terms when the website, our practices or applicable requirements change. The updated version will be published on this page with a revised “Last updated” date.

Changes apply prospectively from publication. Where a change materially affects a paid service or an existing contractual right, we will handle that change in accordance with applicable law and any specific terms for that service.

We may restrict or block access where we reasonably believe a user has engaged in unlawful activity, security abuse, serious misconduct or a material breach of these terms.

15 — Jurisdiction

Governing law and severability

These terms are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws.

The parties submit to the non-exclusive jurisdiction of courts and tribunals with authority in New South Wales. This does not prevent a consumer from relying on rights available under another applicable law or jurisdiction where those rights cannot be excluded.

If a provision of these terms is invalid or unenforceable, it will be read down to the extent reasonably possible. If it cannot be read down, it will be severed without affecting the remaining provisions.
