Scope of this policy

This policy applies to personal information handled through enjoythepain.net, associated forms, newsletters, editorial submissions and communications controlled by Enjoy the Pain.

Where the Privacy Act 1988 (Cth) and the Australian Privacy Principles apply to us, we will handle personal information consistently with those requirements. Even where a statutory small-business exemption may apply, we aim to follow transparent and responsible privacy practices.

Third-party websites, retailers, social platforms and other services linked from Enjoy the Pain have their own privacy practices. This policy does not control how those independent third parties handle information.

Information we may collect

Depending on how you interact with the website, we may collect:

• Enquiry details, including the reason for contacting us and the message you submit.

Where lawful and practical, you may browse public content without identifying yourself. We need accurate contact information when it is impracticable to respond, manage a subscription or administer a relationship anonymously.

Enjoy the Pain uses Brevo to process website forms, maintain contact records, manage newsletter subscriptions and send relevant emails.

Information submitted through the Contact Us form may include your name, email, contact reason, company, message and newsletter preference. Newsletter forms collect your email address and subscription information.

Contacting us does not automatically authorise marketing. Newsletter consent is separate and optional. Where you subscribe, we may keep records of the date, source and status of your consent.

You may unsubscribe using the link included in marketing emails. We may retain a limited suppression record to ensure that an unsubscribed address is not unintentionally added back to an active marketing list.

Cookies, logs and technical information

The website may use cookies and similar technologies that are reasonably necessary for functionality, security, spam prevention, form processing, user preferences, performance and administration.

Our hosting, content-management and security systems may automatically record technical information including an IP address, browser type, device information, requested URL, referring page, date and time, and error or security events.

Google reCAPTCHA

Some forms use Google reCAPTCHA to distinguish legitimate users from automated submissions. When reCAPTCHA loads, Google may receive device, browser and interaction data in accordance with Google’s own privacy policy and terms.

You can configure your browser to restrict cookies. Blocking essential cookies or scripts may prevent parts of the website or its forms from working correctly.

Who may receive information

We may disclose personal information only where reasonably necessary for the purposes described in this policy, including to:

• Brevo, for forms, contact management and email delivery.
• Google, where reCAPTCHA or another clearly disclosed Google service is used.

Security, retention and deletion

We take reasonable administrative, technical and organisational measures designed to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.

Where the Notifiable Data Breaches scheme applies and an eligible data breach is likely to cause serious harm, we will take the steps required by applicable law, which may include notifying affected individuals and the Office of the Australian Information Commissioner.

Marketing and your choices

We send marketing emails only where we have the required consent or another lawful basis. Marketing messages should identify the sender, provide current contact details and contain a functional unsubscribe method.

You may unsubscribe at any time using the link in an email or by contacting us. We will process valid unsubscribe requests within the period required by applicable law.

Opting out of marketing does not prevent us from responding to an enquiry or sending a non-promotional message necessary to administer a relationship you initiated.

Access, correction and deletion requests

Privacy complaints

A privacy concern or complaint may be sent to contact@anjoythepain.net. Please explain what happened, the information involved and the outcome you are seeking.

We will acknowledge and investigate the complaint within a reasonable period, may request further information and will communicate the outcome or proposed resolution.

Where the Privacy Act applies and you are not satisfied with our response, you may be able to complain to the Office of the Australian Information Commissioner at oaic.gov.au.

Children and young people

Enjoy the Pain is intended primarily for a general adult audience and is not designed to knowingly collect personal information from children under 16 without appropriate involvement from a parent or legal guardian.

If you believe a child has provided personal information without appropriate permission, contact us so we can review and, where appropriate, delete it.

Automated decision-making

We do not currently use personal information to make solely automated decisions that could reasonably be expected to significantly affect a person’s legal rights or similarly important interests.

We may use basic automation to route form submissions, send confirmations, manage subscription status, detect spam or organise contact records. Those processes do not independently determine eligibility for employment, credit, insurance, healthcare or another similarly significant outcome.

Changes to this policy

We may update this policy when our website, service providers, information practices or legal requirements change.
